To ensure a safe, enjoyable, and respectful experience for all our guests, we have established the following policies. By participating in our tours, you agree to abide by these guidelines.

1. Liability Waiver

  • We have a liability waiver that will be sent to you after booking and you will need to sign it prior to your tour time.

2. Age Requirement

  • Haunted History Tour is for 18 and older only.

3. Booking and Cancellations

  • Reservations: We recommend booking your tour in advance to secure your spot. Walk-ins are welcome based on availability.
  • Confirmation: Confirmation will be received at the time of booking.
  • Cancellation Policy: Cancellations made at least 24 hours before the scheduled tour time will receive a full refund if insurance was purchased at booking. No refunds will be issued for cancellations made less than 24 hours before the tour.
  • Minimum Travelers: This experience requires a minimum number of travelers. If it is canceled because the minimum is not met, you will be offered a different date/experience or a full refund.
  • Maximum Group Size: 30 on the Family Ghost Tour and 21 on the Haunted History Tour.
  • Participant Insurance: Optional tour insurance is available for purchase during booking. This insurance covers cancellations, interruptions, and certain accidents. Terms and conditions apply.

4. Tour Conduct

  • Arrival: Please arrive at least 15 minutes prior for check-in. Tours depart at their scheduled times. Plan in advance for Ubers, taxis, Lyfts, and travel mishaps. We cannot accommodate late arrivals.
  • Behavior: We expect all guests to behave respectfully toward the guide, fellow tour participants, and the locations we visit. Disruptive behavior, including excessive noise, intoxication, or harassment, will not be tolerated and may result in removal from the tour without a refund.
  • Children: Children 15 and under must be accompanied by an adult. Some tours may not be suitable for young children; please check the tour description for age recommendations.
  • Guide Authority: Tour guides have final authority on all tour-related decisions, including modifying the route or ending the tour early, if necessary, for safety or other reasons.

5. Health and Safety

  • Physical Requirements: Our tours involve walking and standing for extended periods as well as climbing stairs. Please wear comfortable shoes and consider your physical abilities when booking a tour. Most travelers can participate.
  • Weather: Tours will proceed rain or shine. In the event of severe weather, we will contact you regarding any changes.
  • Medical Emergencies: In case of a medical emergency during the tour, our guide will contact emergency services immediately. Participants are responsible for any medical costs incurred.
  • Health Safety Measures: We follow all current local health guidelines. Participants may be required to wear masks or follow other safety measures as deemed necessary.

6. Photography and Recording

  • Photos: Photography is encouraged during the tours, but please respect the privacy of other participants and the properties we visit.
  • Recording: Audio and video recording of the tour guide and the tour content is not permitted without prior consent.

7. Liability and Insurance

  • Waiver of Liability: All participants must sign a waiver of liability before joining the tour. This waiver releases Past and Presence LLC from any liability for injuries, damages, or losses incurred during the tour.
  • Assumption of Risk: By participating in a Titusville Ghost Tour by Past and Presence, LLC, you acknowledge that you assume all risks associated with the tour, including but not limited to physical exertion, weather conditions, and paranormal activities.
  • Release of Liability: Past and Presence LLC, its guides, and affiliates are not liable for any injuries, losses, or damages incurred during the tour.
  • Business Insurance: Past and Presence LLC carries appropriate business insurance; this does not cover individual participants’ personal injuries or losses.
  • Indemnification: By participating in our tours, you agree to indemnify and hold harmless Past and Presence LLC from any claims, damages, losses, liabilities, and expenses arising from your actions during the tour.

6. Photo Usage and Liability Waiver

  • By booking a tour with Past and Presence LLC, you understand and agree that photographs and videos taken during the tour, which may include images of you and your party, can be used in future posts, promotional materials, and advertising.
  • By proceeding with the booking, you grant Past and Presence LLC the right to use these images without any compensation to you. You also waive any right to inspect or approve the finished product wherein your likeness appears, and you release and hold harmless Past and Presence LLC from any liability related to the use of these images.
  • If you have any concerns or wish to opt-out, please contact us before the tour begins.

7. Accessibility

  • Special Needs: We strive to accommodate guests with special needs. Please contact us in advance to discuss any specific requirements or assistance you may need.

8. Privacy

  • Data Collection: We collect personal information, such as names and contact details, for booking purposes only. Your information will not be shared with third parties without your consent.

9. Intellectual Property

  • Content Use: All stories, narratives, and content provided during our tours are the intellectual property of Past and Presence, LLC. Unauthorized copying, reproduction, or use of our tour content for any purpose, including use by other tour companies, is strictly prohibited and will be pursued legally.

10. General Conduct

  • Respect for Locations: Please respect the historic sites and properties we visit. Do not touch or disturb any artifacts or property during the tour.
  • Responsibility: Participants are responsible for their personal belongings. Past and Presence LLC is not liable for any lost or stolen items during the tour.
  • Property Damage: Participants are financially responsible for any damage they cause to properties or equipment during the tour.
  • Alcohol Policy: Alcohol consumption is strictly prohibited during our tours. Participants who appear intoxicated may be denied participation without refund.

11. Group Size

  • 30 Guests

  • By opting into text or other electronic messages, you: (i) expressly consent to be contacted by Past and Presence LLC or our agents for all purposes arising out of or relating to your relationship with us at the telephone number(s) you provide, including for marketing or promotional messages; (ii) agree we may contact you in any way, including SMS messages, and calls, if applicable, and messages delivered using auto telephone dialing system or an automatic texting system; and (iii) represent and warrant that you have read, or had the opportunity to read, and agree to our terms and conditions, located at: Terms & Conditions. While variable based on your purchase behavior, marketing-based text messages will not exceed 5 per month. You understand that consent is not a condition of purchase.
